The rules of the road for our app and dashboard.

These Terms of Service ("Terms") govern your access to and use of the Kinsa Health, LLC ("Kinsa", "we", "us") mobile application and web dashboard (collectively, the "Services"). By creating an account, downloading our app, or accessing the dashboard, you agree to be bound by these Terms.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You agree to provide accurate, complete information when registering and to keep that information up to date.

Subject to these Terms, Kinsa grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Kinsa mobile application on devices you own or control, solely for personal, non-commercial use.

You agree not to reverse engineer, modify, distribute, or create derivative works of the application, except as expressly permitted by applicable law.

Access to the Kinsa dashboard is provided to authorized partners and customers under a separate commercial agreement. Your use of the dashboard is subject to the user roles, seat limits, and data scopes assigned to your organization.

You agree not to share login credentials, exceed authorized usage, or attempt to access data outside your permitted scope.

You agree not to use the Services to: (a) violate any law or regulation; (b) infringe intellectual property or privacy rights; (c) transmit malicious code or attempt to compromise the Services; (d) scrape, harvest, or resell data; or (e) interfere with other users’ use of the Services.

We reserve the right to suspend or terminate accounts that violate these Terms.

The Services provide informational and analytical insights only and are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition.

Forecasts and population-level insights are provided "as is" and may not reflect individual outcomes.

The Services, including all software, data models, designs, and content, are owned by Kinsa or its licensors and are protected by intellectual property laws. No rights are granted to you except those expressly stated in these Terms.

Feedback you provide to Kinsa may be used by us without restriction or compensation.

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied. Kinsa disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Kinsa’s aggregate liability arising out of or relating to these Terms exceed the amounts paid by you to Kinsa in the twelve (12) months preceding the claim, or USD $100 if no fees were paid.

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Sections that by their nature should survive termination will survive.

We may update these Terms from time to time. Material changes will be communicated through the Services or by email. Continued use after the effective date constitutes acceptance of the updated Terms.
